The estimated price should be adjusted to reflect differences in specifications, plans, transportation costs, packaging and packing costs, and other circumstances.

An interested party seeking to protest both the small business size and hubzone status of an apparent successful offeror shall file two separate protests. A) after completing its evaluation, the contracting office shall notify the sba of the extent of its plans to place 8(a) contracts with the sba for specific quantities of items or work.

Protests challenging a subcontractor's small disadvantaged business representation must be filed in accordance with 13 cfr 124. 28, post-award small business program rerepresentation, if the novation agreement was executed prior to inclusion of this clause in the contract.

2) generally, a requirement that was previously accepted into the 8(a) program will only be released for procurements outside the 8(a) program when the contracting activity agency agrees to set aside the requirement under the small business, hubzone, sdvosb, or wosb programs.
